01Acceptance of These Terms

Please read these terms of service carefully. They set out the rules that govern your use of the website published by Behrwald Property LLC at www.behrwald.mom and of the information presented on it.

Behrwald Property LLC (referred to in these terms as Behrwald, we, us, or our) is the operator of this site. Our company is located at 148 E Winslow Ave, South Salt Lake - 84115-4703, United States (US). By accessing this website, by browsing any of its pages, or by using the contact and enquiry facilities we provide, you agree to be bound by these terms. If you do not agree with any part of these terms then please stop using the site and do not send enquiries through it.

These terms describe the relationship between you as a visitor or prospective customer and Behrwald as the owner and operator of the site. They speak only about the website and the general services we describe. Separate and more detailed agreements, noted in these terms, govern actual property management engagements and any tenancy you may ultimately enter into.

We may reasonably ask that you agree to these terms on behalf of a company or other legal body. If you do so then the words you on this page refer to that company in addition to you personally, and you warrant that you hold the authority to bind that body to these terms.

02Description of Services

Behrwald provides professional rental property management and related services. Those services center on the day to day operation of residential addresses owned by third parties and managed on their behalf from our South Salt Lake office.

The services we describe on this site include the following activities:

• Marketing and listing vacant rental units to find qualified tenants.
• Screening applicants through licensed channels and helping to place reliable tenants.
• Preparing and administering leases, renewals, and notices on behalf of owners.
• Collecting rent, holding tenant deposits, keeping ledgers, and distributing net proceeds to owners.
• Coordinating licensed maintenance contractors and recording repair history.
• Performing move in, mid term, and move out inspections and keeping compliance records.

This website introduces those services and lets you request a property walk or send a general enquiry. The actual terms of any engagement are set in a separate written management agreement between Behrwald and the owner, and no statement on this site forms that agreement by itself.

03Eligibility and Your Account

You may use this site only if you are old enough to form a binding contract under the law that applies to you. Our services are intended for adults, and, where property ownership is involved, for owners of residential real estate who have lawful authority to offer a unit for lease.

This site does not generally require you to create a personal account. Where a future feature allows you to open an account or register for a service, the following rules will apply. You must give accurate and complete details and keep them current. You are responsible for safeguarding any password and for all activity that happens under your account. If you suspect that another person has reached your account, you agree to notify our office at once so we can protect your information and our systems.

We may refuse registration, suspend an account, or remove specific users where the account is used in a way that risks the site, breaches these terms, or misleads others.

04Acceptable Use of the Site

You agree to use this site only for its intended purposes and in a lawful manner. You must not use the site in a way that could damage, disable, overburden, or impair the service, or that interferes with any other party.

All content on this site, including text, graphics, logos, page layout, the distinctive color treatment, and the arrangement of information, belongs to Behrwald or to its licensors and is protected by copyright, trademark, and other intellectual property laws.

The name Behrwald, the Behrwald wordmark, and the office style associated with our branding are used to identify our services. You may not use our name, logo, or branding for any purpose that suggests an endorsement or that you are an official partner of this company unless we have agreed in writing.

We grant you a limited, personal, non exclusive, and revocable permission to view the site in the normal way a browser does and to print or download pages for your own private and non commercial reference. Everything beyond that permission, such as copying content for another website, reselling text, or building a derivative design, requires our separate written agreement.

06Information You Provide

Where the site invites you to send details through the contact form or by email, you agree that the information you provide is accurate, current, and given in good faith. This matters because we may use your details to schedule a property walk, to assess whether our services fit your needs, or to begin a screening enquiry.

You understand that neither sending an enquiry nor writing to update@behrwald.mom creates a management or tenancy agreement with us. A property management relationship begins only when a written management agreement is signed by the owner and accepted by our office, and a tenancy begins only when a written lease is signed by all the necessary parties.

By sending us personal details and supporting documents you consent to our use of them as described in our Privacy Policy, which forms part of your relationship with this site. You are responsible for any material that you choose to submit, and you agree that you will not send us unlawful, defamatory, or confidential material that does not belong to you.

08Fees and Payment Terms

Any fees that apply to a specific property engagement are set out in the separate management agreement and its attached schedule of fees, not in these website terms.

Where we offer a paid service that can be selected from this site, the price shown at the time of selection is the price that applies, together with any taxes the law requires. Payment is due as described at the point of purchase unless we agree otherwise. If a payment fails, we may pause the related service until the amount is settled.

Rent and tenant deposits are never paid to us through this website. Such funds are collected under the terms of a signed lease and are handled by the property office through the banking methods described to the parties involved.

09Management Agreement Governs

Whenever a genuine conflict arises between the general statements on this website and the signed documents that govern a particular service, the signed document will win. This point is important for our owners.

If you are an owner, the terms of your management agreement control how rent is collected, how maintenance is approved, what responsibilities Behrwald carries, and what the owner remains responsible for. A marketing page on a website can never replace the tailored detail of that agreement, and it should not be read as doing so.

If you are a tenant, the signed lease and its addenda control the rent, the term, the security deposit, the house rules, and the notice that applies to your occupancy. Nothing on this site creates or modifies a tenancy or waives a right under a signed lease.

Our total liability to you arising out of or relating to the use of this site will not exceed the greater of the amount you have paid us through the site in the twelve months before the claim or one hundred United States dollars. This limit applies whether the claim is founded in contract, tort, negligence, strict liability, or another legal theory.

The exclusions and limits in this section do not apply where the law forbids them, for example for liability that cannot lawfully be excluded. Nothing in these terms reduces any right you hold that cannot be waived by agreement.

13Indemnification

You agree to defend, indemnify, and hold harmless Behrwald Property LLC and its affiliates, officers, employees, and agents from and against any claim, loss, damage, liability, or expense, including reasonable legal fees, that arises from your breach of these terms, your misuse of the site, or your submission of unlawful or misleading material.

This indemnity also covers claims that arise because you represented authority that you did not hold, such as offering a property that you had no right to lease or signing a tenant representation on behalf of another person without permission.

We reserve the right, at our own expense, to assume exclusive control of the defense of any matter subject to this indemnity. In that event you agree to cooperate with our reasonable requests so we can conduct a proper defense. This section survives the end of your right to use the site.

14Termination and Suspension

We may suspend or terminate your ability to use any part of this site if you breach these terms, if you misuse the site, or if we believe that continued use risks the security or integrity of our systems or the interests of our property owners or tenants.

Where you misuse the enquiry facilities, such as by sending abusive or fraudulent messages, we may block the address concerned and decline future contact through that channel without further notice. Independent management and tenancy agreements are not affected by these website terms except as the agreements themselves say.

You may stop using the site at any time. Sections of these terms that ought to survive a termination, such as those concerning ownership, indemnity, limitation of liability, and governing law, will continue to apply after you stop.

15Governing Law and Dispute Resolution

These terms and your use of the site are governed by the laws of the State of Utah in the United States, without regard to its conflict of laws principles. The property office that operates this site is based in South Salt Lake within the State of Utah.

If a dispute cannot be resolved by discussion then, to the extent the law allows, the courts of the State of Utah will have exclusive jurisdiction, and you agree to submit to that jurisdiction. Where a statute grants you a non waivable right to bring a claim in the state or country where you live, this section does not override that right.

This governing law clause addresses only the website terms. Any dispute under a signed management agreement or a lease is resolved under whatever provisions that separate document contains.

16Changes to These Terms

We may update these terms from time to time to reflect changes in our services, in the law, or in how our office works. When we make a material revision we will post the new version on this page and change the last updated date at the top of the document.

Your continued use of the site after a revised version is posted means that you accept the changes, subject to any right the law gives you and to any requirement for separate consent where a material change demands it. We encourage you to check this page each time you return.

We will not apply a revised term in a way that unfairly rewrites a duty you owed under a signed agreement without giving you appropriate notice and, where the law requires, your agreement.
